x2ftp note: the writer (M.Nemcoff) has composed music for several (USA) national network themes, motion pictures and games, so he really knows what he's talking about. --jouni From: Mark Nemcoff <71652.546@CompuServe.COM> Newsgroups: rec.games.programmer Subject: Re: Sampling music for games. What is legal? Date: 3 Mar 1995 23:40:53 GMT Organization: Melodyvision I'll make it quick. The law says that if you sample anything at all >from a commercially available recording or from a recorded performance of any artist that you have to get clearance from the owners of the copyrighted work or risk a lawsuit. There is no ceiling on damages since you may be potentially destroying the public's perception of a work of art. So, in short, if you are planning on using music, either get it cleared through the Harry Fox Agency in NYC or use original music. There is no such thing as a free ride as far as commercial music is concerned. Period. -- MN
